Terms of Sale Agreement

Upon purchase, the buyer acknowledges and confirms that they have read, understand, and agree to all of the terms set fourth in this terms of sale agreement.

All Sales are Final, No Exceptions. We sell gasoline-powered vehicles and therefore they carry a limited warranty. Any cosmetic and/or mechanical problems with the purchase should be reported to us within 48 hours of receipt of the bike.

Manufacturers Warranty: This warranty guarantees that the buyer will receive a brand new 100% functional product. The buyer understands and agrees that if the product arrives damaged or in any way defective, the buyer, if required will return the damaged parts and replacement parts will be provided to the buyer free of charge for them to replace himself or herself. This warranty does not cover any shipping fees, labor, or damages, misuse, or abuse by the end user or from any unforeseen events.

Shipping & Handling : There are absolutely no refunds and/or compensation provided to the buyer for any shipping and handling fees incurred.

Shipping Damage: If the bike arrives and there is slight damage incurred during shipment, please contact us to resolve these minor issues. If there is significant and/or un-repairable damage to the bike, please contact us as well as the shipping entity immediately to file damage report and/or claim. NOTICE!! The buyer is required to provide pictures along with your notification to: admin@hotpowersports.com, documenting any damages. Notification from the buyer regarding any issues with the bike, including missing parts, is expected within 48 hours of buyer’s receipt of the bike.

Refunds and Disputes: All payments to hotpowersports.com are nonrefundable. If you dispute a charge to your credit card issuer that, in hotpowersports.com's sole discretion is a valid charge under the provisions of our policies, you agree that you are liable to pay the full amount disputed, including an additional "Administrative Fee" of $150.00, as well as a monthly interest rate of 1.5% on the total amount owed, until the total amount owed is paid in full. Delivery refusals and/or order cancellations are subject to a 10% restocking fee, plus the shipping fees incurred, if any.

Returns: Any and all major defects and/or other unforeseen issues, which require the return of a bike to hotpowersports.com, must have a return authorization by hotpowersports.com before the bike may be returned. Any items returned without approval will be refused. The buyer is responsible for any and all shipping and insurance costs for returns.

Privacy Policy: hotpowersports.com takes the task of protecting your personal information very seriously and will never share and/or sell your personal information to a third party. The only exception to this policy is if we are required to do so by law and/or court order.

Hotpowersports.com sells gasoline-powered vehicles, which are intended for closed-course, competition, recreational, and/or off-road usage. By purchasing any of the vehicles available from hotpowersports.com, you confirm that you are at least 18 years of age. In order to successfully complete an order and purchase vehicles from hotpowersports.com you must confirm when ordering that you agree to all hotpowersports.com policies. By ordering, you agree that you will not hold hotpowersports.com and/or it's owner(s), supplier(s), or it's employee(s) liable for any circumstances which occur as a result of your purchase, possession, use, abuse, and/or misuse of the vehicle(s) you have purchased, including but not limited to, any form of direct and/or indirect damages, usage, misuse, abuse, injuries, and/or death. The buyer also assumes complete responsibility for the legal purchase, possession, operation, and/or usage of any vehicle purchased from hotpowersports.com, within the buyers city, state, and/or county. These are motorized, gas powered vehicles, and proper safety apparel should be worn at all times.

No Assignment. Neither the rights nor the obligations arising under this Agreement are assignable or transferable by You without our express written consent, and any such attempted assignment or transfer shall be void and without effect.

Controlling Law; Severability. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida without regard to conflicts of laws provisions thereof. You agree to submit to the exclusive jurisdiction and venue of the federal and state courts located in the State of Florida and County of Lee. In the event that any of the provisions of this Agreement shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.

Entire Agreement; Amendment; Waiver. This Agreement constitutes the entire agreement between the parties pertaining to the subject matter hereof, and supercedes any and all written or oral agreements heretofore existing between the parties. No waiver or modification of this Agreement will be binding upon either party unless made in a writing signed by both parties and no failure or delay in enforcing any right will be deemed a waiver.

The entire contents of this web site is protected by copyright. ANY attempts to duplicate, replicate, and/or copy any portion of this web site, in part or whole, will be dealt with accordingly.
